The carrier is legally responsible for making sure the safety and security declaration is completed on time. The carrier is defined as the active mode of transport. So, a container or unaccompanied trailer on a ship, would mean the shipping line is responsible. If the trailer is driver accompanied, then the haulage company would be responsible. The carrier is allowed to get a third party to complete the S&S declaration on their behalf.
